This Platform Privacy Policy explains how ATMO Technologies GmbH (hereinafter "ATMO", "we", or "us") processes your personal data and operational data when you register on our platform at platform.atmo.earth, create a user account, and use our AI-powered analysis services.

This policy supplements the general privacy policy of our marketing website (atmo.earth).

2. Categories of Processed Data

In order to create a structured assessment and a bank-ready financing analysis for your agricultural business, we process the documents and information uploaded by you. Since many agricultural businesses are operated as sole proprietorships or civil law partnerships (GbR), such data may relate to identifiable individuals.

We process the following categories of data:

Financial and Operational Data

Business, tax, and financing-related documents, including information on assets, revenues, financing structures, investment-related offers, and business plans.

Geodata and Agricultural Operational Data

Digital land, geospatial, and farm management data, including field, cultivation, and subsidy-related information, as well as analyses derived therefrom.

Account and Contact Data

Name, company or farm information, contact details, and encrypted access credentials.

3. Purposes and Legal Bases of Processing

We process your data exclusively for the following purposes and on the basis of the following legal grounds:

3.1 Provision of the Platform and Performance of Contract

The processing of your uploaded documents is carried out in order to provide the service requested by you: the automated and structured preparation of your operational data into a professional assessment ("Bank Assessment").

Legal basis: Art. 6(1)(b) GDPR (performance of a contract). The use of the platform is currently free of charge for farmers, but constitutes a contractual usage relationship.

3.2 Platform Operations, IT Security, and Infrastructure

To ensure platform stability, detect system errors, and technically operate our analysis models, server logs and processing metrics are temporarily stored.

Legal basis: Art. 6(1)(f) GDPR (legitimate interest in ensuring the operational security of our platform).

3.3 Improvement and Training of Our In-House AI Models (Voluntary Opt-In)

If you have provided your explicit and separate consent during registration or in your account settings, we may use your uploaded documents and operational data to train and improve our proprietary algorithms and AI models. To protect your privacy, the data is automatically cleaned, filtered, and anonymized to the greatest extent possible prior to the actual training process.

Legal basis: Art. 6(1)(a) GDPR (consent).

Right to Withdraw Consent: You may withdraw your consent at any time with future effect by sending an email to info@atmo.earth. The lawfulness of processing carried out before the withdrawal remains unaffected. Refusing or withdrawing consent will not affect the regular functionality of the platform.

4. Data Processing by External AI Infrastructure

For the automated extraction, analysis, and structuring of uploaded documents, the platform uses third-party AI models provided through cloud infrastructure within the European Union, including services from Amazon Web Services and Anthropic.

Data Processing Agreements

Where personal data is processed by external infrastructure or AI service providers, such processing is carried out on the basis of data processing agreements pursuant to Art. 28 GDPR.

Data Processing within the EU

ATMO strives to process sensitive financial, operational, and geospatial data exclusively within the European Union. At present, data center locations in Germany are primarily used for this purpose.

No Use for Model Training Purposes

Based on our current understanding and the contractual agreements with the third-party providers used, uploaded customer data is not used to improve generally available AI models.

5. Disclosure of Data

Within ATMO, only those employees who require access to your data for contract fulfillment and technical platform support are granted access.

No Unauthorized Disclosure

Your data is not sold, rented, or disclosed to third parties (such as banks, authorities, or advertising networks). Data is only transferred to financial institutions if you actively download and submit the generated analysis to your bank yourself, or if you expressly authorize us to do so.

6. Storage Duration and Deletion

We store your data only for as long as you actively maintain your user account on our platform.

If you delete your user account, all associated documents and analyses will be deleted immediately and completely from our databases and connected cloud storage systems.

If you withdraw your consent for model training, your data will be removed from future training pipelines without undue delay.

Excluded from deletion are data that we are required to retain due to statutory tax or commercial retention obligations. Such data will be blocked from regular platform operations.

7. No Automated Decision-Making (Art. 22 GDPR)

Our platform does not carry out automated decision-making or profiling within the meaning of Art. 22 GDPR. The assessment generated by ATMO serves solely as a preparatory analytical support tool. Final lending decisions are made exclusively by human reviewers at the banks contacted by you.

8. Your Data Subject Rights

You may exercise your statutory rights under the GDPR against us at any time, including the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), and data portability (Art. 20).

You also have the right to lodge a complaint with the competent supervisory authority (Berlin Commissioner for Data Protection and Freedom of Information).
